In accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan dated July 9, 2004 "On the protection, reproduction and use of the animal world" I HEREBY ORDER:

1. To approve the attached Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation.

2. The Committee for Forestry and Wildlife of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, in the manner prescribed by law, shall ensure:

1) state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;

2) posting this Order on the Internet resource of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after the state registration of this Order, the submission to the Department of Legal Service of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph.

3. Control over the implementation of this Order shall be entrusted to the supervising Vice-Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan.

4. This Order shall come into effect upon the expiration of twenty-one calendar days after the day of its first official publication.

Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation

Chapter 1. General Provisions

1. These Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation (hereinafter – the Rules) have been developed in accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan "On the protection, reproduction and use of wildlife" (hereinafter – the Law) and shall determine the procedure of organization and conduct of accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation.

2. The following basic concepts shall be used in these Rules:

1) accreditation – a procedure of official recognition by an accreditation body of an applicant's competence to perform works in a specific area of conformity assessment;

2) subject of accreditation – republican associations of public associations of hunters and subjects of hunting industry (hereinafter – the association);

3) hunting minimum (hereinafter – the hunting minimum) – a special short course of a training program covering matters of the legislation of the Republic of Kazakhstan in the field of protection, reproduction, and use of wildlife, safety precautions during hunting, knowledge of which is a mandatory condition for issuance of a hunter's certificate;

4) authorized body – the authorized state body in the field of protection, reproduction, and use of wildlife;

5) department of the authorized body – a subdivision of the authorized body.

3. Accreditation shall be carried out by the agency of the authorized body to confirm the powers of the accreditation subject to carry out the types of activities provided for by Article 33-1 of the Law.

4. Accreditation procedure:

1) publication of the announcement of accreditation;

2) submission by associations to the department of the authorized body of documents specified in paragraph 7 of these Rules;

3) consideration of accreditation materials;

4) issuance of accreditation certificate or reasoned refusal to issue it.

Chapter 2. Procedure for conducting accreditation

5. The announcement of the terms and conditions of accreditation in Kazakh and Russian shall be posted on the Internet resource of the department of the authorized body ten days before accreditation.

7. The list of the main requirements for the provision of public service, including the characteristics of the process, the form, content and result of the provision, as well as other information taking into account the peculiarities of the provision of public service, shall be set out in Annex 7 to these Rules.

Within three working days from the date of approval of the regulatory legal act on amendments and (or) additions to these Rules, the authorized body shall send information on the amendments and (or) additions made to the single contact center.

8. On the day the documents are received, the Service Provider shall accept and register them.

Within 1 (one) working day of the registration of the Service Recipient’s application, the designated employee shall verify the completeness and validity of the submitted documents.

If the Service Recipient submits all required documents via

the Portal, the Service Recipient’s “personal account” will display the status indicating that the request for the public service has been accepted, along with the date on which the result of

the public service will be received.

If the Service Recipient submits an incomplete set of documents in accordance with the List of Basic Requirements for the Provision of Public Services set forth in these Rules, and/or documents whose validity period has expired (as specified in Appendix 7), the Service Provider shall refuse to accept the application.

10. The department of the authorized body shall, within 3 (three) working days from the moment of receipt of the application, issue a certificate of accreditation or send a reasoned refusal.

11. The grounds for refusal to render a public service established by the legislation of the Republic of Kazakhstan are set out in Appendix 7 to these Rules.

In the event that grounds for refusal to render a public service are identified in accordance with Article 73 of the Administrative Procedure and Procedural Code of the Republic of Kazakhstan, the service provider shall notify the service recipient of a preliminary decision on the refusal to render a public service, as well as the time and place (method) of conducting a hearing to enable the service recipient to express their position on the preliminary decision.

The notification of the hearing shall be sent no later than 3 (three) working days before the expiry of the period for rendering the public service.

The hearing shall be conducted no later than 2 (two) working days from the date of notification.

Based on the results of the hearing, the service provider shall issue a certificate of accreditation of republican associations of public associations of hunters and subjects of hunting industry or a reasoned response on the refusal to render a public service.

12. The certificate of accreditation of republican associations of public associations of hunters and subjects of hunting industry shall be issued for a period of four years in the form according to Appendix 4 to these Rules.

13. A certificate of accreditation shall be inalienable and may not be transferred to third parties.

14. In cases of change of name and (or) legal address, the association shall submit an application within five working days from the date of the change for re-registration of the accreditation certificate to the agency of the authorized body in the form specified in Annex 6 to the Rules.

15. The decision on accreditation or refusal of accreditation of the association shall be appealed in the manner prescribed by the legislation of the Republic of Kazakhstan.

16. The accreditation certificate shall terminate in the following cases:

1) expiration of its validity period;

2) reorganization or liquidation of the association;

3) submission by the association of an application for voluntary termination of the certificate;

4) identification by the agency of the authorized body of facts of improper performance of activities provided for by Article 33-1 of the Law.

17. Suspension, resumption, and deprivation (revocation) of the certificate of accreditation shall be carried out in accordance with the procedure and (or) on the grounds provided for by Article 45 of the Law of the Republic of Kazakhstan "On Permits and Notifications".

Chapter 3. Procedure for appealing the results of accreditation of republican associations of public associations of hunters and subjects of hunting industry

18. A complaint against a decision, actions (inaction) of the Service Provider’s employees shall be filed in the name of the Head of the Service Provider and (or) to the authorized body for assessing and monitoring the public services quality in accordance with the Administrative Procedural and Process-Related Code of the Republic of Kazakhstan and the Law “On Public Services” (hereinafter referred to as the Law on Public Services).

The complaint of the Service Receiver, received by the Service Provider, in accordance with paragraph 2 of Article 25 of the Law on Public Services is subject to consideration within 5 (five) working days from the date of its registration.

The complaint of the Service Receiver, received by the authorized body for assessing and monitoring the public services rendering quality, in accordance with paragraph 2 of Article 25 of the Law on Public Services, is subject to consideration within 15 (fifteen) working days from the date of its registration.

19. In cases of disagreement with the Service Provider’s decision, the Service Receiver shall apply to the court in accordance with subparagraph 6) of Article 4 of the Law on Public Services.

8.	List of documents and information required from the service recipient for the provision of the public service	1) an application in the form according to Annex 1 to these Rules; 2) electronic copies of documents confirming the availability of: equipped premises for conducting a theoretical course under the hunting minimum program, held on the right of ownership and (or) other legal grounds; a website; branches and (or) representative offices (if any); specialized literature in the field of protection, reproduction, and use of wildlife, methodological materials, manuals, and exhibits on the hunting minimum; The service provider shall obtain the said information from the relevant state information systems through the "e-Government" gateway; an appropriate staff of employees with professional education in the field of protection, reproduction, and use of wildlife; public associations of amateur hunters within the association. 3) a form of information for republican associations of public associations of hunters and subjects of hunting industry, in the form according to Appendix 2 to these Rules. The service provider shall obtain information on the state registration (re-registration) of a legal entity from the relevant state information systems through the "e-Government" gateway.
9.	Grounds for refusal to provide the public service, established by the laws of the Republic of Kazakhstan	1) establishment of the unreliability of the documents submitted by the service recipient for obtaining a public service, and (or) the data (information) contained therein; 2) non-compliance of the service recipient and (or) the submitted materials, objects, data, and information necessary for rendering a public service with the requirements established by these Rules; 3) there is an effective court decision (verdict) regarding the service recipient on the prohibition of activities or certain types of activities requiring the receipt of a specific public service; 4) there is an effective court decision regarding the service recipient, on the basis of which the service recipient has been deprived of a special right related to the receipt of a public service. 5) absence of the service recipient's consent, provided in accordance with Article 8 of the Law of the Republic of Kazakhstan "On Personal Data and Their Protection", to access restricted personal data that are required for rendering a public service.
10. В соответствии с подпунктом 40) пункта 1 статьи 9 Закона Республики Казахстан от 9 июля 2004 года "Об охране, воспроизводстве и использовании животного мира" ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства, проведении их аккредитации.

2. Комитету лесного хозяйства и животного мира Министерства экологии, геологии и природных ресурсов Республики Казахстан в установленном законодательством порядке обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) размещение настоящего приказа на интернет-ресурсе Министерства экологии, геологии и природных ресурсов Республики Казахстан после его официального опубликования;

3) в течение десяти рабочих дней после государственной регистрации настоящего приказа представление в Департамент юридической службы Министерства экологии, геологии и природных ресурсов Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1) и 2) настоящего пункта.

3. Контроль за исполнением настоящего приказа возложить на курирующего вице-министра экологии, геологии и природных ресурсов Республики Казахстан.

Правила аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства, проведении их аккредитации

Глава 1. Общие положения

1. Настоящие Правила аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства, проведении их аккредитации (далее – Правила) разработаны в соответствии с подпунктом 40) пункта 1 статьи 9 Закона Республики Казахстан "Об охране, воспроизводстве и использовании животного мира" (далее – Закон) и определяют порядок организации и проведения аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства, проведении их аккредитации.

2. В настоящих Правилах используются следующие основные понятия:

1) аккредитация - процедура официального признания органом по аккредитации компетентности заявителя выполнять работы в определенной области оценки соответствия;

2) субъект аккредитации – республиканские ассоциации общественных объединений охотников и субъектов охотничьего хозяйства (далее – ассоциация);

3) охотничий минимум (далее – охотминимум) – специальный краткий курс обучающей программы, рассматривающий вопросы законодательства Республики Казахстан в области охраны, воспроизводства и использования животного мира, техники безопасности при охоте, знание которой является обязательным условием для выдачи удостоверения охотника;

4) уполномоченный орган – уполномоченный государственный орган в области охраны, воспроизводства и использования животного мира;

5) ведомство уполномоченного органа – подразделение уполномоченного органа.

3. Аккредитация проводится ведомством уполномоченного органа для подтверждения правомочий субъекта аккредитации осуществлять виды деятельности, предусмотренным статьей 33-1 Закона.

4. Процедура проведения аккредитации:

1) опубликование объявления о проведении аккредитации;

2) представление ассоциациями в ведомство уполномоченного органа документов, указанных в пункте 7 настоящих Правил;

3) рассмотрение материалов аккредитации;

4) выдача свидетельства об аккредитации или мотивированный отказ о его выдачи.

Глава 2. Порядок проведения аккредитации

5. Объявление о сроках и условиях проведения аккредитации на казахском и русском языках размещается на интернет-ресурсе ведомства уполномоченного органа за десять дней до проведения аккредитации.

7. Перечень основных требований к оказанию государственной услуги, включающий характеристики процесса, форму, содержание и результат оказания, а также иные сведения с учетом особенностей предоставления государственной услуги изложены в приложении 7 к настоящим Правилам.

Уполномоченный орган в течение трех рабочих дней с даты утверждения нормативного правового акта о внесении изменений и (или) дополнений в настоящие Правила направляет информацию о внесенных изменениях и (или) дополнениях в Единый контакт-центр.

8. Услугодатель в день поступления документов осуществляет их прием, регистрацию.

Ответственный работник в течение 1 (один) рабочих дней с момента регистрации заявления Услугополучателя, проверяет полноту и сроки действия представленных документов.

При подаче Услугополучателем всех необходимых документов посредством

Портала – в "личном кабинете" Услугополучателя отображается статус о принятии запроса для оказания Государственной услуги с указанием даты получения результата

Государственной услуги.

В случаях представления услугополучателем неполного пакета документов согласно Перечню основных требований к оказанию государственной услуги, изложенного в к настоящим Правилам, и (или) документов с истекшим приложении 7 сроком действия услугодатель отказывает в приеме заявления.

10. Ведомство уполномоченного органа в течение 3 (три) рабочих дней с момента поступления заявки выдает свидетельство об аккредитации или направляет мотивированный отказ.

11. Основания для отказа в оказании государственной услуги, установленные законодательством Республики Казахстан, изложены в приложении 7 к настоящим Правилам.

При выявлении оснований для отказа в оказании государственной услуги в соответствии со статьей 73 Административного процедурно-процессуального кодекса Республики Казахстан, услугодатель уведомляет услугополучателя о предварительном решении об отказе в оказании государственной услуги, а также времени и месте (способе) проведения заслушивания для возможности выразить услугополучателю позицию по предварительному решению.

Уведомление о заслушивании направляется не менее чем за 3 (три) рабочих дня до завершения срока оказания государственной услуги.

Заслушивание проводится не позднее 2 (двух) рабочих дней со дня уведомления.

По результатам заслушивания услугодатель выдает свидетельство об аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства либо мотивированный ответ об отказе в оказании государственной услуги.

12. Свидетельство об аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства выдается сроком на четыре года по форме, согласно приложению 4 к настоящим Правилам.

13. Свидетельство об аккредитации является неотчуждаемым и не подлежит передаче третьим лицам.

14. В случаях изменения наименования и (или) юридического адреса ассоциация в течение пяти рабочих дней со дня изменения подает заявление для переоформления свидетельства об аккредитации в ведомство уполномоченного органа по форме, согласно приложению 6 к настоящим Правилам.

15. Решение об аккредитации либо отказе в аккредитации ассоциации обжалуется в порядке, установленном законодательством Республики Казахстан.

16. Свидетельство об аккредитации прекращает свое действие в случаях:

1) истечения срока его действия;

2) реорганизации или ликвидации ассоциации;

3) представления ассоциацией заявления о добровольном прекращении действия свидетельства;

4) выявления ведомством уполномоченного органа фактов ненадлежащего осуществления деятельности, предусмотренным статьей 33-1 Закона.

17. Приостановление, возобновление действия, лишение (отзыв) свидетельства об аккредитации осуществляется в порядке и (или) по основаниям, предусмотренным статьей 45 Закона Республики Казахстан "О разрешениях и уведомлениях".

Глава 3. Порядок обжалования результатов аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства

18. Жалоба на решение, действия (бездействия) работников Услугодателя подается на имя руководителя Услугодателя и (или) в уполномоченный орган по оценке и контролю за качеством оказания государственных услуг в соответствии с Административным процедурно-процессуальным Кодексом Республики Казахстан и Законом "О государственных услугах" (далее – Закон о государственных услугах).

Жалоба Услугополучателя, поступившая в адрес Услугодателя, в соответствии с пунктом 2 статьи 25 Закона о государственных услугах подлежит рассмотрению в течение 5 (пяти) рабочих дней со дня ее регистрации.

Жалоба Услугополучателя, поступившая в адрес уполномоченного органа по оценке и контролю за качеством оказания государственных услуг, в соответствии с пунктом 2 статьи 25 Закона о государственных услугах подлежит рассмотрению в течение 15 (пятнадцати) рабочих дней со дня ее регистрации.

19. В случаях несогласия с результатами решения Услугодателя Услугополучатель обращается в суд в соответствии с подпунктом 6) статьи 4 Закона о государственных услугах.

Перечень основных требований к оказанию государственной услуги "Аккредитация республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства"
1.	Наименование Услугодателя	Комитет лесного хозяйства и животного мира Министерства экологии природных ресурсов Республики Казахстан и
2.	Способы предоставления государственной услуги (каналы доступа)	Веб-портал "электронного правительства": www.egov.kz (далее – Портал).
3.	Срок оказания государственной услуги	3 (трех) рабочих дней.
4.	Форма оказания Государственной услуги	Электронная (частично автоматизированная.
5.	Результат оказания государственной услуги	Свидетельство об аккредитации республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства или мотивированный отказ в оказании государственной услуги. Форма предоставления результата оказания Государственной услуги: электронная.
6.	Размер оплаты, взимаемой с Услугополучателя при оказании государственной услуги, и способы ее взимания в случаях, предусмотренных законодательством Республики Казахстан	Государственная услуга оказывается бесплатно.
7.	График работы услугодателя, Государственной корпорации и объектов информации	1) Услугодателя – с понедельника по пятницу с 9.00 до 18.30 часов, с перерывом на обед с 13.00 до 14.30 часов, кроме выходных и праздничных дней; 2) Портала – круглосуточно, за исключением перерывов, связанных с проведением технических работ (при обращении Услугополучателя после окончания рабочего времени, в выходные и праздничные дни, прием заявки и документов, выдача результатов оказания Государственной услуги осуществляется следующим рабочим днем).
8.	Перечень документов и сведений, истребуемых у услугополучателя для оказания государственной услуги	1) заявление по форме согласно приложению 1 к настоящим Правилам; 2) электронные копии документов, подтверждающие наличие: на праве собственности и (или) иных законных основаниях оборудованных помещений для проведения теоретического курса по программе охотминимума; веб-сайта; филиалов и (или) представительств (при наличии); специальной литературы в области охраны воспроизводства и использования животного мира, методических материалов, пособий и экспонатов по охотминимуму; Данные сведения услугодатель получает из соответствующих государственных информационных систем через шлюз "электронного правительства"; соответствующего штата сотрудников с профессиональным образованием в области охраны, воспроизводства и использования животного мира; общественных объединений охотников-любителей в составе ассоциации. 3) форму сведений для республиканских ассоциаций общественных объединений охотников и субъектов охотничьего хозяйства, по форме, согласно приложению 2 к настоящим Правилам. Сведения о государственной регистрации (перерегистрации) юридического лица Услугодатель получает из соответствующих государственных информационных систем через шлюз "электронного правительства".
9.	Основания для отказа в оказании Государственной услуги, установленные законодательством Республики Казахстан	1) установление недостоверности документов, представленных услугополучателем для получения государственной услуги, и (или) данных (сведений), содержащихся в них; 2) несоответствие услугополучателя и (или) представленных материалов, объектов, данных и сведений, необходимых для оказания государственной услуги, требованиям, установленным настоящими Правилами; 3) в отношении услугополучателя имеется вступившее в законную силу решение (приговор) суда о запрещении деятельности или отдельных видов деятельности, требующих получения определенной государственной услуги; 4) в отношении услугополучателя имеется вступившее в законную силу решение суда, на основании которого услугополучатель лишен специального права, связанного с получением государственной услуги. 5) отсутствие согласия услугополучателя, предоставляемого в соответствии со статьей 8 Закона Республики Казахстан "О персональных данных и их защите", на доступ к персональным данным ограниченного доступа, которые требуются для оказания государственной услуги.
10.	Иные требования с учетом особенностей оказания Государственной услуги, в том числе оказываемой в электронной форме	1) адреса мест оказания Государственной услуги размещены на: единой платформе интернет-ресурсов государственных органов – www.gov.kz, в разделе "Министерство экологии и природных ресурсов" в подразделе "Услуги"; Портале; 2) Услугополучатель имеет возможность получения Государственной услуги в электронной форме посредством Портала при условии наличия электронной цифровой подписи; 3) Услугополучатель имеет возможность получения информации о порядке и статусе оказания Государственной услуги в режиме удаленного доступа посредством "личного кабинета" Портала, а также Единого контакт-центра; 4) при оказании государственной услуги посредством Портала доступна версия для слабовидящих; 5) контактные телефоны справочных служб по вопросам оказания Государственной услуги указаны на единой платформе интернет-ресурсов государственных органов – www.gov.kz, в разделе "Министерство экологии и природных ресурсов" в подразделе "Услуги". Единый контакт-центр по вопросам оказания государственных услуг: 1414, 8-800-080-7777.
