In accordance with subparagraph 20-27) of Article 11 of the Law of the Republic of Kazakhstan "On tourist activities in the Republic of Kazakhstan," I hereby ORDER:
1. Approve the attached Rules for the activities of guides and tourism instructors.
2. the Committee of the Tourism Industry of the Ministry of Tourism and Sports of the Republic of Kazakhstan in the procedure prescribed by the legislation of the Republic of Kazakhstan to ensure:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) place this order on the Internet resource of the Ministry of Tourism and Sports of the Republic of Kazakhstan;
3) within three working days after the execution of subparagraph 1) and 2) of this paragraph, provide information on the execution to the Department of the Legal Service of the Ministry of Tourism and Sports of the Republic of Kazakhstan.
3. Control over the execution of this order shall be entrusted to the supervising Deputy Minister of Tourism and Sports of the Republic of Kazakhstan.
4. This order shall enter into force upon expiry of ten calendar days after the date of its first official publication.

Rules for the activities of guides, tour guides and tourism instructors Chapter 1. General provisions
1. These Rules for the activities of guides and tourism instructors (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 20-27) of Article 11 of the Law of the Republic of Kazakhstan "On tourist activities in the Republic of Kazakhstan" and shall determine the procedure for the activities of guides and tourism instructors.
2. The following basic concepts shall be used in these Rules:
1) guide - an individual professionally trained to provide information and (or) organizational services to tourists, operating in the Republic of Kazakhstan;
2) tourism instructor - a professionally trained individual operating in the Republic of Kazakhstan, having appropriate qualifications and experience in completing tourist routes;
3) the state register of tourist routes and trails - a document recording tourist routes and trails;
4) tourist product - a complex of all necessary tourist services sufficient to meet the needs of a tourist while traveling;
5) tour guide - an individual professionally trained to conduct excursions to tourists to familiarize themselves with tourist attractions in the country (place) of temporary stay, carrying out activities in the Republic of Kazakhstan.
Chapter 2. Activities of guides, tour guides and tourism instructors
3. Guides, tour guides and tourism instructors shall carry out activities if they have citizenship of the Republic of Kazakhstan and a notification of the start of activities.
4. Notification of the start or termination of the activities of a guide, guide, tourism instructor in the Republic of Kazakhstan is carried out in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications."
Notification of the start of the activities of a guide, tour guide, tourism instructor shall be submitted on the Internet resource www.elicense.kz according to the forms of information for the annex to the notification of the start of travel agent activities, the activities of a guide, tour guide and tourism instructor operating in the Republic of Kazakhstan as individual entrepreneurs, approved by the Law of the Minister for Investment and Development of the Republic of Kazakhstan dated February 27, 2015 № 249 (registered in the register of state registration of regulatory legal acts under № 11209).
5. The authorized body in the field of tourist activities shall maintain a state electronic register of individuals who have filed a notification of the beginning or termination of the activities of a guide, tour guide and tourism instructor in accordance with the Law of the Republic of Kazakhstan "On permits and notifications".
The register of guides, tour guides and tourism instructors shall be posted on the official Internet resources of the authorized body in the field of tourism activities and the organization created by the Government of the Republic of Kazakhstan in order to develop domestic and inbound tourism.
6. Guides, tour guides and tourism instructors shall provide tourist services on the basis of an agreement by agreement of the parties concluded between the guide, tour guide, tourism instructor and tourist, in accordance with the legislation of the Republic of Kazakhstan.
To conclude an agreement, a tourist shall provide a guide, tour guide, tourism instructor with information about himself and the individuals in whose favour the contract shall be concluded, in the amount necessary to fulfil obligations under such an agreement.
7. Guides, tour guides and tourism instructors, 3 (three) calendar days before the start of the trip in writing shall provide tourists with information about the features of travel, including the necessary and reliable information about the rules of entry, stay in the country (place) of temporary stay, about the legislation, about the customs of the local population, about religious rites, shrines, natural monuments, history, culture and other objects of tourist display under special protection, the state of the environment, as well as about the dangers that they may encounter when traveling, and implement preventive measures aimed at ensuring the safety of tourists.
8. Guides, tour guides and tourism instructors shall, within one (1) working day, immediately shall inform the authorized body in the field of tourist activities and the authorized body in the field of civil protection, as well as the tourist's family from the moment when they learned or should have learned about the emergency with the tourist during the trip.
If an emergency occurred with foreign tourists on the territory of the Republic of Kazakhstan, guides, tour guides and tourism instructors also inform the diplomatic service authorities.
9. When passing routes that pose a threat to the life and health of a tourist within the Republic of Kazakhstan, guides, tour guides and tourism instructors obtain written consent from the tourist that the tourist shall be informed and shall agree with the possible risk to life on this tourist route, to ensure the safety of his life and health.
Local executive bodies of the capital, regions and cities of republican significance shall maintain a state register of tourist routes and trails in accordance with the Law of the Republic of Kazakhstan "On Tourist Activities in the Republic of Kazakhstan."
10. Guides, tour guides and tourism instructors in carrying out activities shall provide reliable information to tourists, should not allow distortion of facts and committing actions that violate the standards of the legislation of the Republic of Kazakhstan and the rights of tourists.
11. Tourist guides and tourism instructors in their activities shall provide tourists with organizational services for the implementation of preparatory activities and accompanying a tourist along the route, aimed at coordinating his interaction with other services, without the formation, promotion and sale of a tourist product.
12. Tour guides in their activities shall provide excursion services for the organization of visits to tourist resources for educational purposes in the country (place) of temporary stay, which shall not provide for accommodation (overnight stay) of tourists and shall cover a period of not more than twenty-four hours.
