Қазақстан Республикасы Экология, геология және табиғи ресурстар министрінің м.а. 2020 жылғы 31 қаңтардағы № 28 бұйрығы. Қазақстан Республикасының Әділет министрлігінде 2020 жылғы 31 қаңтарда № 19960 болып тіркелді.

"Жануарлар дүниесін қорғау, өсімін молайту және пайдалану туралы" 2004 жылғы 9 шілдедегі Қазақстан Республикасы Заңының 9-бабы 1-тармағының 40) тармақшасына сәйкес БҰЙЫРАМЫН:

1. Қоса беріліп отырған Аңшылардың және аңшылық шаруашылығы субъектілерінің қоғамдық бірлестіктерінің республикалық қауымдастықтарын аккредиттеу, оларды аккредиттеуден өткізу қағидалары бекітілсін.

2. Қазақстан Республикасы Экология, геология және табиғи ресурстар министрлігінің Орман шаруашылығы және жануарлар дүниесі комитеті заңнамада белгіленген тәртіппен:

1) осы бұйрықтың Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркелуін;

2) осы бұйрық ресми жарияланғаннан кейін оның Қазақстан Республикасы Экология, геология және табиғи ресурстар министрлігінің интернет-ресурсында орналастырылуын;

3) осы бұйрық мемлекеттік тіркелгеннен кейін он жұмыс күн ішінде Қазақстан Республикасы Экология, геология және табиғи ресурстар министрлігінің Заң қызметі департаментіне осы тармақтың 1) және 2) тармақшаларында көзделген іс-шаралардың орындалуы туралы мәліметтердің ұсынылуын қамтамасыз етсін.

3. Осы бұйрықтың орындалуын бақылау жетекшілік ететін Қазақстан Республикасының Экология, геология және табиғи ресурстар вице-министріне жүктелсін.

4. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік жиырма бір күн өткен соң қолданысқа енгізіледі.

1-тарау. Жалпы ережелер

1. Осы Аңшылардың және аңшылық шаруашылығы субъектілерінің қоғамдық бірлестіктерінің республикалық қауымдастықтарын аккредиттеу, оларды аккредиттеуден өткізу қағидалары (бұдан әрі – Қағидалар) "Жануарлар дүниесін қорғау, өсімін молайту және пайдалану туралы" Қазақстан Республикасы Заңының (бұдан әрі – Заң) 9-бабы 1-тармағының 40) тармақшасына сәйкес әзірленді және аңшылардың және аңшылық шаруашылығы субъектілерінің қоғамдық бірлестіктерінің республикалық қауымдастықтарын аккредиттеуді, оларды аккредиттеуден өткізуді ұйымдастыру және жүргізу тәртібін анықтайды.

2. Осы Қағидаларда мынадай негізі ұғымдар пайдаланылады:

1) аккредиттеу – аккредиттеу жөніндегі орган өтініш берушінің белгілі бір салада сәйкестікті бағалау жұмыстарын орындау құзыретін ресми танитын рәсім;

2) аккредиттеу субъектісі – аңшылардың және аңшылық шаруашылығы субъектілерінің қоғамдық бірлестіктерінің республикалық қауымдастықтары (бұдан әрі – қауымдастық);

3) аңшылық минимумы – оқыту бағдарламасының Қазақстан Республикасының жануарлар дүниесін қорғау, өсімін молайту және пайдалану саласындағы заңнамасының, аңшы куәлігін беру үшін білу міндетті шарт болып табылатын аң аулау кезіндегі қауіпсіздік техникасының мәселелерін қарастыратын арнайы қысқаша курсы;

4) уәкілетті орган – жануарлар дүниесін қорғау, өсімін молайту және пайдалану саласындағы уәкілетті мемлекеттік орган.

5) уәкілетті орган ведомствосы – уәкілетті органның бөлімшесі.

3. Аккредиттеуді Заңның 33-1-бабында көзделген қызмет түрлерін жүзеге асыру құқығын растау үшін уәкілетті орган ведомствосы аккредиттеу субъектісіне жүргізеді.

4. Аккредиттеуді жүргізу рәсімдері:

1) аккредиттеуді жүргізу туралы хабарландыру жариялау;

2) қауымдастықтардың уәкілетті орган ведомствосына осы Қағидалардың 7-тармағында көрсетілген құжаттарды беруі;

3) аккредиттеу материалдарын қарауы;

4) аккредиттеу туралы куәлікті беру немесе оны беруден дәлелді бас тарту.

2-тарау. Аккредиттеуді жүргізу тәртібі

5. Аккредиттеу мерзімі мен оны өткізу шарттары туралы хабарландыру аккредиттеу жүргізілгенге дейін он жұмыс күн бұрын уәкілетті орган ведомствосының ресми интернет-ресурсында қазақ және орыс тілдерінде орналастырылады.

7. Мемлекеттік қызмет көрсету процесінің сипаттамасын, нысанын, мазмұны мен нәтижесін, сондай-ақ мемлекеттік қызмет көрсету ерекшеліктерін ескере отырып, өзге де мәліметтерді қамтитын мемлекеттік қызмет көрсетуге қойылатын негізгі талаптардың тізбесі осы Қағидаларға 7-қосымшада келтірілген.

Уәкілетті орган осы Қағидаларға өзгерістер және (немесе) толықтырулар енгізу туралы нормативтік құқықтық актіні бекіткен күннен бастап үш жұмыс күні ішінде енгізілген өзгерістер және (немесе) толықтырулар туралы ақпаратты Бірыңғай байланыс орталығына жібереді.

8. Көрсетілетін қызметті беруші құжаттар келіп түскен күні оларды қабылдауды, тіркеуді жүзеге асырады.

Жауапты қызметкер көрсетілетін қызметті алушының өтініші тіркелген сәттен бастап 1 (бір) жұмыс күні ішінде ұсынылған құжаттардың толықтығын және қолданылу мерзімдерін тексереді.

Көрсетілетін қызметті алушы барлық қажетті құжаттарды Портал арқылы берген кезде Көрсетілетін қызметті алушының "жеке кабинетінде" мемлекеттік көрсетілетін қызмет нәтижесін алу күнін көрсете отырып, мемлекеттік қызметті көрсету үшін сұрау салудың қабылданғаны туралы мәртебесі көрсетіледі.

Көрсетілетін қызметті алушы осы Қағидаларға баяндалған 7-қосымшада мемлекеттік қызметті көрсетуге қойылатын негізгі талаптардың Тізбесіне сәйкес құжаттар топтамасын және (немесе) қолданылу мерзімі өткен құжаттарды толық ұсынбаған жағдайларда көрсетілетін қызметті беруші өтінішті қабылдаудан бас тартады.

10. Уәкілетті орган ведомствосы өтінім түскен сәттен бастап 3 (үш) жұмыс күні ішінде аккредиттеу туралы куәлікті береді немесе аккредиттеуден дәлелді бас тарту жібереді.

12. Аңшылар және аңшылық шаруашылығы субъектілері қоғамдық бірлестіктерінің республикалық қауымдастықтарын аккредиттеу туралы куәлік осы Қағидаларға 4-қосымшаға сәйкес нысан бойынша төрт жыл мерзімге беріледі.

13. Аккредиттеу туралы куәлік иеліктен шығарылмайды және үшінші тұлғаларға берілуге жатпайды.

14. Атауы және (немесе) орналасқан жері өзгерген жағдайда қауымдастық бес жұмыс күні ішінде уәкілетті орган ведомствосына аккредиттеу туралы куәлікті қайта ресімдеу туралы осы Қағидаларға 6-қосымшаға сәйкес нысан бойынша өтініш береді.

15. Қауымдастықтың аккредиттеу туралы не аккредиттеуден бас тарту туралы шешіміне Қазақстан Республикасының заңнамасында белгіленген тәртіппен шағым жасалуы мүмкін.

16. Аккредиттеу туралы куәлік өзінің қолданылуын:

1) оның қолданылу мерзімі аяқталған;

2) қауымдастықтың қайта ұйымдастырылған немесе таратылған;

3) қауымдастық куәліктің қолданылуын өз еркімен тоқтату туралы өтініш берген;

4) уәкілетті орган ведомствосы Заңның 33-1-бабында көзделген қызметтің тиісті дәрежеде жүзеге асырылмауы туралы фактілерді анықтаған жағдайларда тоқтатылады.

Көрсетілетін қызметті берушінің атына келіп түскен Көрсетілетін қызметті алушының шағымы Мемлекеттік қызметтер туралы Заңы 25-бабының 2-тармағына сәйкес тіркелген күнінен бастап 5 (бес) жұмыс күні ішінде қаралуға жатады.

Мемлекеттік көрсетілетін қызметтер көрсету сапасын бағалау және бақылау жөніндегі уәкілетті органның атына келіп түскен Көрсетілетін қызметті алушының шағымы Мемлекеттік көрсетілетін қызметтер туралы Заңы 25-бабының 2-тармағына сәйкес тіркелген күнінен бастап 15 (он бес) жұмыс күні ішінде қаралуға жатады.

4) жануарлар дүниесi объектілерінің мониторингіне және есебін алуға қатысу;

5) балық ресурстарын және басқа да су жануарларын қоспағанда, жануарлар әлемі объектілерін алып қою квоталарын бөлу;

6) аң аулауға пайдаланылатын аушы жыртқыш құстарды тіркеу мен есепке алуды жүргізу;

7) өз филиалдары мен өкілдіктері арқылы аңшы куәлігін беру, белгіленген нысан бойынша аң аулаушының берілген куәлігі туралы есептемені уәкілетті органға ұсыну;

8) бекітіп берілген аңшылық алқаптарында аң аулау объектілері болып табылатын жануарлар түрлерінің санын есепке алуды жүргізуге қатысуды, аңшылық шаруашылығының субъектілері ұсынған деректерді талдау мен жалпылауды және жануарлар дүниесі объектілерін алып қою лимитін дайындау үшін уәкілетті орган ведомствосының аумақтық бөлімшелеріне ұсынымдар енгізу;

9) жануарлар дүниесiнің өсiмiн молайтуды ұйымдастыруды;

10) аңшылық алқаптарды бекітіп беру жөніндегі конкурстық комиссияларға қатысу;

11) аушы жыртқыш құстар мен аңшылық иттерді пайдалана отырып, аң аулаудың ұлттық түрлерін дамытуды ұйымдастыруды;

12) Жарғыда көзделген және Қазақстан Республикасының заңнамасында тыйым салынбаған өзге де қызметті жүзеге асырады.

9.	Қазақстан Республикасының заңнамасында белгіленген мемлекеттік қызмет көрсетуден бас тарту үшін негіздер	1) көрсетілетін қызметті алушы мемлекеттік көрсетілетін қызметті алу үшін ұсынған құжаттардың және (немесе) олардағы деректердің (мәліметтердің) анық еместігін анықтау; 2) көрсетілетін қызметті алушының және (немесе) мемлекеттік қызметті көрсету үшін қажетті ұсынылған материалдардың, объектілердің, деректер мен мәліметтердің осы Қағидаларда белгіленген талаптарға сәйкес келмеуі; 3) көрсетілетін қызметті алушыға қатысты белгілі бір мемлекеттік көрсетілетін қызметті алуды талап ететін қызметке немесе жекелеген қызмет түрлеріне тыйым салу туралы заңды күшіне енген сот шешімінің (үкімінің) болуы; 4) көрсетілетін қызметті алушыға қатысты соттың заңды күшіне енген шешімінің болуы, оның негізінде көрсетілетін қызметті алушы мемлекеттік көрсетілетін қызметті алуға байланысты арнайы құқығынан айырылуы. 5) Қазақстан Республикасының "Дербес деректер және оларды қорғау туралы" Заңының 8-бабына сәйкес көрсетілетін қызметті алушының мемлекеттік қызмет көрсету үшін қажет шектеулі қолжетімділікпен пайдаланылатын жеке деректерге қол жеткізуге берген келісімінің болмауы.
10. In accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan dated July 9, 2004 "On the protection, reproduction and use of the animal world" I HEREBY ORDER:

1. To approve the attached Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation.

2. The Committee for Forestry and Wildlife of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, in the manner prescribed by law, shall ensure:

1) state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;

2) posting this Order on the Internet resource of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after the state registration of this Order, the submission to the Department of Legal Service of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph.

3. Control over the implementation of this Order shall be entrusted to the supervising Vice-Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan.

4. This Order shall come into effect upon the expiration of twenty-one calendar days after the day of its first official publication.

Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation

Chapter 1. General Provisions

1. These Rules for the accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation (hereinafter – the Rules) have been developed in accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan "On the protection, reproduction and use of wildlife" (hereinafter – the Law) and shall determine the procedure of organization and conduct of accreditation of republican associations of public associations of hunters and subjects of hunting industry, the conduct of their accreditation.

2. The following basic concepts shall be used in these Rules:

1) accreditation – a procedure of official recognition by an accreditation body of an applicant's competence to perform works in a specific area of conformity assessment;

2) subject of accreditation – republican associations of public associations of hunters and subjects of hunting industry (hereinafter – the association);

3) hunting minimum (hereinafter – the hunting minimum) – a special short course of a training program covering matters of the legislation of the Republic of Kazakhstan in the field of protection, reproduction, and use of wildlife, safety precautions during hunting, knowledge of which is a mandatory condition for issuance of a hunter's certificate;

4) authorized body – the authorized state body in the field of protection, reproduction, and use of wildlife;

5) department of the authorized body – a subdivision of the authorized body.

3. Accreditation shall be carried out by the agency of the authorized body to confirm the powers of the accreditation subject to carry out the types of activities provided for by Article 33-1 of the Law.

4. Accreditation procedure:

1) publication of the announcement of accreditation;

2) submission by associations to the department of the authorized body of documents specified in paragraph 7 of these Rules;

3) consideration of accreditation materials;

4) issuance of accreditation certificate or reasoned refusal to issue it.

Chapter 2. Procedure for conducting accreditation

5. The announcement of the terms and conditions of accreditation in Kazakh and Russian shall be posted on the Internet resource of the department of the authorized body ten days before accreditation.

6. Excluded by order of the Minister of Ecology and Natural Resources of the Republic of Kazakhstan dated 23.01.2023 № 14 (shall enter into force upon expiry of sixty calendar days after the day of its first official publication).

7. The list of the main requirements for the provision of public service, including the characteristics of the process, the form, content and result of the provision, as well as other information taking into account the peculiarities of the provision of public service, shall be set out in Annex 7 to these Rules.

Within three working days from the date of approval of the regulatory legal act on amendments and (or) additions to these Rules, the authorized body shall send information on the amendments and (or) additions made to the single contact center.

8. On the day the documents are received, the Service Provider shall accept and register them.

Within 1 (one) working day of the registration of the Service Recipient’s application, the designated employee shall verify the completeness and validity of the submitted documents.

If the Service Recipient submits all required documents via

the Portal, the Service Recipient’s “personal account” will display the status indicating that the request for the public service has been accepted, along with the date on which the result of

the public service will be received.

If the Service Recipient submits an incomplete set of documents in accordance with the List of Basic Requirements for the Provision of Public Services set forth in these Rules, and/or documents whose validity period has expired (as specified in Appendix 7), the Service Provider shall refuse to accept the application.

9. Excluded by order of the Minister of Ecology and Natural Resources of the Republic of Kazakhstan dated 23.01.2023 № 14 (shall enter into force upon expiry of sixty calendar days after the day of its first official publication).

10. The department of the authorized body shall, within 3 (three) working days from the moment of receipt of the application, issue a certificate of accreditation or send a reasoned refusal.

11. The grounds for refusal to render a public service established by the legislation of the Republic of Kazakhstan are set out in Appendix 7 to these Rules.

In the event that grounds for refusal to render a public service are identified in accordance with Article 73 of the Administrative Procedure and Procedural Code of the Republic of Kazakhstan, the service provider shall notify the service recipient of a preliminary decision on the refusal to render a public service, as well as the time and place (method) of conducting a hearing to enable the service recipient to express their position on the preliminary decision.

The notification of the hearing shall be sent no later than 3 (three) working days before the expiry of the period for rendering the public service.

The hearing shall be conducted no later than 2 (two) working days from the date of notification.

Based on the results of the hearing, the service provider shall issue a certificate of accreditation of republican associations of public associations of hunters and subjects of hunting industry or a reasoned response on the refusal to render a public service.

12. The certificate of accreditation of republican associations of public associations of hunters and subjects of hunting industry shall be issued for a period of four years in the form according to Appendix 4 to these Rules.

13. A certificate of accreditation shall be inalienable and may not be transferred to third parties.

14. In cases of change of name and (or) legal address, the association shall submit an application within five working days from the date of the change for re-registration of the accreditation certificate to the agency of the authorized body in the form specified in Annex 6 to the Rules.

15. The decision on accreditation or refusal of accreditation of the association shall be appealed in the manner prescribed by the legislation of the Republic of Kazakhstan.

16. The accreditation certificate shall terminate in the following cases:

1) expiration of its validity period;

2) reorganization or liquidation of the association;

3) submission by the association of an application for voluntary termination of the certificate;

4) identification by the agency of the authorized body of facts of improper performance of activities provided for by Article 33-1 of the Law.

17. Suspension, resumption, and deprivation (revocation) of the certificate of accreditation shall be carried out in accordance with the procedure and (or) on the grounds provided for by Article 45 of the Law of the Republic of Kazakhstan "On Permits and Notifications".

Chapter 3. Procedure for appealing the results of accreditation of republican associations of public associations of hunters and subjects of hunting industry

18. A complaint against a decision, actions (inaction) of the Service Provider’s employees shall be filed in the name of the Head of the Service Provider and (or) to the authorized body for assessing and monitoring the public services quality in accordance with the Administrative Procedural and Process-Related Code of the Republic of Kazakhstan and the Law “On Public Services” (hereinafter referred to as the Law on Public Services).

The complaint of the Service Receiver, received by the Service Provider, in accordance with paragraph 2 of Article 25 of the Law on Public Services is subject to consideration within 5 (five) working days from the date of its registration.

The complaint of the Service Receiver, received by the authorized body for assessing and monitoring the public services rendering quality, in accordance with paragraph 2 of Article 25 of the Law on Public Services, is subject to consideration within 15 (fifteen) working days from the date of its registration.

19. In cases of disagreement with the Service Provider’s decision, the Service Receiver shall apply to the court in accordance with subparagraph 6) of Article 4 of the Law on Public Services.

1.	Name of the Service Provider	The Committee on Forestry and Wildlife of the Ministry of Ecology of Natural Resources of the Republic of Kazakhstan and

The service provider shall obtain information on the state registration (re-registration) of a legal entity from the relevant state information systems through the "e-Government" gateway.
9.	Grounds for refusal to provide the public service, established by the laws of the Republic of Kazakhstan	1) establishment of the unreliability of the documents submitted by the service recipient for obtaining a public service, and (or) the data (information) contained therein; 2) non-compliance of the service recipient and (or) the submitted materials, objects, data, and information necessary for rendering a public service with the requirements established by these Rules; 3) there is an effective court decision (verdict) regarding the service recipient on the prohibition of activities or certain types of activities requiring the receipt of a specific public service; 4) there is an effective court decision regarding the service recipient, on the basis of which the service recipient has been deprived of a special right related to the receipt of a public service. 5) absence of the service recipient's consent, provided in accordance with Article 8 of the Law of the Republic of Kazakhstan "On Personal Data and Their Protection", to access restricted personal data that are required for rendering a public service.
10.
