2. Қазақстан Республикасы Еңбек және халықты әлеуметтік қорғау министрлігінің Көші-қон комитеті Қазақстан Республикасының заңнамасында белгіленген тәртіппен:

1) осы бұйрықтың Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркелуді;

2) осы бұйрықты Қазақстан Республикасы Еңбек және халықты әлеуметтік қорғау министрлігінің интернет-ресурсында орналастыруды;

3) осы бұйрық Қазақстан Республикасы Әділет министрлігінде мемлекеттік тіркелгеннен кейін он жұмыс күні ішінде Қазақстан Республикасы Еңбек және халықты әлеуметтік қорғау министрлігінің Заң қызметі департаментіне осы тармақтың 1) және 2) тармақшаларында көзделген іс-шараларды орындау туралы мәліметтердің ұсынылуын қамтамасыз етсін.

3. Осы бұйрықтың орындалуын бақылау Қазақстан Республикасының Еңбек және халықты әлеуметтік қорғау бірінші вице-министріне жүктелсін.

4. Осы бұйрық 2023 жылғы 28 ақпаннан бастап қолданысқа енгізіледі және ресми жариялануға жатады.

Шетелдіктердің Қазақстан Республикасында тұрақты тұруға рұқсат алуы үшін сұранысқа ие кәсіптердің тізбесін қалыптастыру қағидалары

1-тарау. Жалпы ережелер

1. Осы Шетелдіктердің Қазақстан Республикасында тұрақты тұруға рұқсат алуы үшін сұранысқа ие кәсіптердің тізбесін қалыптастыру қағидалары (бұдан әрі – Қағидалар) "Халықтың көші-қоны туралы" Қазақстан Республикасы Заңының 11-бабының 6-1) тармақшасына сәйкес әзірленді және шетелдіктердің тұрақты тұруға рұқсат алу мақсатында сұранысқа ие кәсіптердің тізбесін (бұдан әрі – Тізбе) қалыптастыру тәртібін айқындайды.

2. Осы Қағидаларда мынадай негізгі ұғымдар пайдаланылады:

1) халықтың көші-қоны мәселелері жөніндегі уәкілетті орган (бұдан әрі – уәкілетті орган) – өз құзыреті шегінде халықтың көші-қоны саласындағы басшылықты, көші-қон процестерін реттеуді, халықтың көші-қоны саласындағы жұмысты үйлестіруді және мемлекеттік саясатты іске асыруды жүзеге асыратын орталық атқарушы орган;

2) шетелдіктер – Қазақстан Республикасының азаматтары емес және өзiнiң басқа мемлекеттiк азаматтығына қатысты екендiгiнiң дәлелi бар адамдар;

3) "Электрондық еңбек биржасы" мемлекеттік цифрлық порталы – Қазақстан Республикасының Әлеуметтік кодексіне сәйкес жұмыс іздеуді және персоналды іріктеуге жәрдемдесуді, жұмыспен қамту саласында электрондық және проактивті форматта қызметтер көрсетуді қамтамасыз ететін, жұмыс іздеушілер мен жұмыс берушілерге арналған жұмыспен қамтудың бірыңғай цифрлық платформасын білдіретін цифрлық объектісі.

2-тарау. Шетелдіктердің Қазақстан Республикасында тұрақты тұруға рұқсат алуы үшін сұранысқа ие кәсіптердің тізбесін қалыптастыру тәртібі

3. Тізбені қалыптастыру үшін уәкілетті орган:

1) жұмыс берушілермен шетелдік жұмыс күшін тартатын кәсіптер туралы "Шетелдік жұмыс күші" автоматтандырылған цифрлық жүйесінің мәліметтеріне;

2) Қазақстан Республикасы Еңбек және халықты әлеуметтік қорғау министрінің 2023 жылғы 20 мамырдағы №161 бұйрығымен (Нормативтік құқықтық актілерді мемлекеттік тіркеу тізілімінде № 32546 тіркелген) бекітілген Еңбек ресурстарын болжаудың ұлттық жүйесін қалыптастыру және оның нәтижелерін пайдалану қағидаларына сәйкес қалыптастырылған кадрларға қажеттіліктің орта мерзімді болжамына;

3) "Электрондық еңбек биржасы" мемлекеттік цифрлық порталының бос жұмыс орындарына талдау жүргізеді.

4. Уәкілетті орган осы Қағиданың 3-тармағына сәйкес жүргізілген талдау негізінде Тізбенің жобасын қалыптастыруға мүдделі мемлекеттік және жергілікті атқарушы органдарға Қазақстан Республикасының Ұлттық кәсіпкерлік палатасына (бұдан әрі – ҰКП) келісуге жібереді.

5. Мүдделі мемлекеттік және жергілікті атқарушы органдар, ҰКП Тізбе жобасын алған күннен бастап он жұмыс күні ішінде Тізбе жобасын келіседі немесе уәкілетті органға ұсыныстар жолдайды.

Егер Тізбенің жобасы он жұмыс күнінен астам келісуде болса және ол бойынша жауап берілмесе, онда Тізбенің жобасы әдепкі бойынша "келісілген" болып есептеледі.

6. Уәкілетті орган осы Қағидалардың 5-тармағына сәйкес келіп түскен ұсыныстарды ескере отырып Тізбені бекітеді.

On approval of the list of demanded professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan and the Rules for its formation

In accordance with subparagraph 6-1) of Article 11 of the Law of the Republic of Kazakhstan "On population migration", I hereby ORDER:

1. Approve:

1) Rules for the formation of a list of demanded professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan in accordance with Annex 1 to this order;

2) the list of professions in demand for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan in accordance with Annex 2 to this order.

2. to the Migration Committee of the Ministry of Labour and Social Protection of the Population of the Republic of Kazakhstan in the manner prescribed by the legislation of the Republic of Kazakhstan to ensure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) place this order on the Internet resource of the Ministry of Labour and Social Protection of the Republic of Kazakhstan;

3) within ten working days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, submit to the Department of Legal Service of the Ministry of Labour and Social Protection of the Republic of Kazakhstan of information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

3. Control over the execution of this order shall be entrusted to the First Deputy Minister of Labour and Social Protection of the Population of the Republic of Kazakhstan.

4. This order comes into force on February 28, 2023 and is subject to official publication.

Annex 1 to the order Minister of Labour and Social Protection of the Population of the Republic of Kazakhstan

Rules for the formation of a list of demanded professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan Chapter 1. General provisions

1. These Rules for the formation of a list of demanded professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan (hereinafter referred to as the Rules) were developed in accordance with subparagraph 6-1) of Article 11 of the Law of the Republic of Kazakhstan "On population migration" and shall determine the procedure for the formation of a list of demanded professions (hereinafter referred to as the List) in order for foreigners to obtain a permanent residence permit.

2. The following basic concepts are used in these Rules:

1) the authorized body on population migration issues (hereinafter referred to as the authorized body) is the central executive body that, within its competence, exercises leadership in the field of population migration, regulation of migration processes, coordination of work and implementation of state policy in the field of population migration;

2) foreigners - persons who are not citizens of the Republic of Kazakhstan and have evidence of their belonging to the citizenship of another state;

3) the state information portal "Electronic labour exchange" - an information system containing a unified information base of the labour market.

Chapter 2. Procedure for forming a list of demanded professions for foreigners to obtain a permanent residence permit in the Republic of Kazakhstan

3. To form the List, the authorized body analyses:

1) information of the automated information system "Foreign labor force" about professions in which foreign labour force shall be attracted by the employer;

2) medium-term forecast of the need for personnel, formed in accordance with the Rules for the formation of a national system for forecasting labour resources and the use of its results, approved by the order of the Minister of Labour and Social Protection of the Republic of Kazakhstan dated May 20, 2023 № 161 (registered in the Register of State Registration of Regulatory Legal Acts № 32546);

3) vacancies of the state information portal "Electronic labour exchange".

4. The authorized body, based on the analysis carried out in accordance with paragraph 3 of these Rules, draws up a draft List and sends it for approval to the interested state and local executive bodies, the National Chamber of Entrepreneurs of the Republic of Kazakhstan (hereinafter referred to as the NCE).

5. Within ten working days from the date of receipt of the draft List, interested state and local executive bodies and NCE shall approve or send proposals to the draft List to the authorized body.

If the draft List is under approval for more than ten working days and no response is provided, the draft List shall be considered as "approved" by default.

6. The authorized body shall approve the List taking into account the proposals received in accordance with Paragraph 5 to the Rules.
