In accordance with Article 30 of the Law of the Republic of Kazakhstan “On Mass Media” and subparagraph 88) of paragraph 15 of the Regulation on the Ministry of Foreign Affairs of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated October 28, 2004 No. 1118, I HEREBY ORDER:

To approve the attached Rules for the accreditation of representative offices of foreign mass media and their journalists.
2. The International Information Committee of the Ministry of Foreign Affairs of the Republic of Kazakhstan shall ensure the following:
1) in accordance with the procedure established by law, state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan, sending a copy of it in printed and electronic form for official publication in periodicals and the information and legal system "Adilet";
3) within five working days from the date of receipt of this Order from the Ministry of Justice of the Republic of Kazakhstan, sending a copy of it in printed and electronic form to the Republican State Enterprise on the Right of Economic Management “Republican Center for Legal Information of the Ministry of Justice of the Republic of Kazakhstan” for inclusion in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;
4) posting this Order on the official Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan.
3. Control over the implementation of this Order shall be assigned to the supervising Deputy Minister of Foreign Affairs of the Republic of Kazakhstan.
4. This Order shall come into effect upon expiration of ten calendar days after the date of its first official publication.

The Rules for the accreditation of representative offices of foreign mass media outlets and their journalists

Chapter 1. General Provisions
1. These Rules for the accreditation of representative offices of foreign mass media outlets and their journalists (hereinafter referred to as the Rules) have been developed in accordance with Article 30 of the Law of the Republic of Kazakhstan “On Mass Media”, subparagraph 88) of paragraph 15 of the Regulation on the Ministry of Foreign Affairs of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated October 28, 2004 No. 1118, and determine the procedure for the accreditation of representative offices of foreign mass media (hereinafter referred to as Media) and their journalists.
2. Professional journalistic activities in the Republic of Kazakhstan of foreign media representatives and their journalists shall be carried out based on accreditation.
3. The following terms and definitions shall be used in these Rules:
1) Mass media – a periodical printed publication, television or radio channel, or online publication;
2) applicant – an authorized representative of a foreign media outlet requesting accreditation in the Republic of Kazakhstan of a representative office of a foreign media outlet or its journalists.
Chapter 2. Procedure for accreditation, refusal, suspension and revocation of accreditation of foreign media outlets Section 1. Procedure for accreditation and refusal of accreditation of foreign media outlets
4. To obtain accreditation for a representative office of a foreign media outlet, the applicant shall submit the following documents to the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter referred to as the Ministry) in person or via the Ministry’s official email address accreditation@mfa.kz (hereinafter referred to as the Official email address):
1) a signed application in any form for accreditation of a representative office of a foreign media outlet with the provision of documents confirming the applicant’s authority;
2) constituent documents (agreement) and (or) charter of a foreign media outlet (if any);
3) documents issued in accordance with the legislation of a foreign state and confirming the registration of a foreign media outlet;
4) information about the foreign media outlet, indicating the full name of the foreign media outlet, history of operations, legal address, and contact information.
Documents issued, drawn up or certified in the established form by competent authorities of foreign states are accepted subject to legalization, unless otherwise provided by the legislation of the Republic of Kazakhstan or an international treaty ratified by the Republic of Kazakhstan.
Documents drawn up in a foreign language shall be accompanied by a duly certified translation into the state and/or Russian languages.
5. In the event of submission of an incomplete set of documents according to the list provided in paragraph 4 of these Rules, and/or documents with an expired period of validity, the Ministry shall return them to the applicant without consideration within 3 (three) working days from the date of submission of the documents.
The return of documents shall not be the grounds for refusing to consider them if the applicant reapplies after the reasons for the return of the documents have been eliminated.
6. The Ministry, within 2 (two) months from the date of receipt of the documents specified in paragraph 4 of these Rules, shall review them and notify the applicant in writing:
1) on accreditation of a representative office of a foreign media outlet;
2) on the refusal to accredit a representative office of a foreign media outlet, with justification for the reasons for making such a decision.
The period for reviewing documents shall be extended by a reasoned decision of the head of the Ministry or his deputy for a reasonable period, but no more than 2 (two) months, due to the need to establish factual circumstances that are significant for their proper review, of which the applicant shall be notified within 3 (three) working days from the date of extension of the period.
7. A decision to refuse accreditation to a representative of a foreign media outlet shall be made in the following cases:
1) establishing the fact that the applicant provided false information (documents) when applying for accreditation;
2) entry into force of a decision of a court of the Republic of Kazakhstan on the suspension or termination of the publication/broadcasting of a foreign media outlet, or the distribution of products of a foreign media outlet on the territory of the Republic of Kazakhstan;
3) violations of the legislation of the Republic of Kazakhstan by foreign media.
8. Accreditation of a representative office of a foreign media outlet shall be carried out for a period of 5 (five) years.
9. In the event of loss of the notification of accreditation of a foreign media representative, the applicant shall submit to the Ministry, in person or via the official e-mail address, a signed application in any form for its replacement.
The Ministry shall issue a duplicate notification of accreditation of a representative office of a foreign media outlet within 5 (five) working days from the date of acceptance of the application.
10. The applicant, no later than 3 (three) working days from the date of change of the information specified in the notification of accreditation of a representative office of a foreign media outlet, as well as in the documents of the foreign media provided to the Ministry, specified in subparagraphs 2), 3) and 4) of paragraph 4 of these Rules, informs the Ministry of the changes made.
Section 2. Procedure for suspension and revocation of accreditation of foreign media outlets
11. The accreditation of a representative office of a foreign media outlet shall be suspended in the following cases:
1) the entry into force of a decision of a court of the Republic of Kazakhstan on the suspension of the publication/broadcasting of a foreign media outlet, or the distribution of the products of a foreign media outlet on the territory of the Republic of Kazakhstan for the period and under the conditions specified in such decision of the court of the Republic of Kazakhstan;
2) failure to provide information to the Ministry in accordance with paragraph 10 of these Rules;
3) violations by the representative office of a foreign media outlet of the legislation of the Republic of Kazakhstan.
12. The revocation of accreditation of a representative office of a foreign media outlet shall be carried out in the following cases:
1) entry into force of a decision of the court of the Republic of Kazakhstan on the termination of the publication of a foreign media outlet, or the distribution of products of a foreign media outlet on the territory of the Republic of Kazakhstan;
2) entry into force of decisions of the court of the Republic of Kazakhstan and (or) authorized bodies (officials) of the Republic of Kazakhstan for violation of the legislation of the Republic of Kazakhstan;
3) violation by a representative of a foreign media outlet of the legislation of the Republic of Kazakhstan within 1 (one) year after suspension of accreditation.
13. In the event of suspension or revocation of the accreditation of a representative office of a foreign media outlet, the Ministry shall notify the representative office of the foreign media outlet in writing of the suspension or revocation of its accreditation no later than 3 (three) working days from the date of the decision.
After the circumstances that served as the grounds for the suspension of the accreditation of a foreign media representative have been eliminated, the Ministry shall, within 3 (three) working days, resume the accreditation and notify the representative office of the foreign media outlet in writing of this decision.
Chapter 3. Procedure for accreditation, refusal, suspension and revocation of accreditation of a journalist of a foreign media outlet Section 1. Procedure for accreditation and refusal of accreditation of a journalist of a foreign media outlet
14. Accreditation of a journalist of a foreign media outlet shall be carried out by the Ministry on a permanent or temporary basis, regardless of the citizenship and permanent place of residence of the journalist of the foreign media outlet.
15. Accreditation of a journalist of a foreign mass media outlet shall be granted for the following period:
1) for permanent accreditation – up to 1 (one) year, but not more than the period of accreditation of the representative office of a foreign media outlet;
2) for temporary accreditation – for the period specified in the application of the foreign media outlet, but not more than 3 (three) months.
16. For permanent accreditation of a journalist of a foreign media outlet, the applicant or journalist of a foreign media outlet shall submit to the Ministry in person or via the official e-mail address:
1) a signed petition in any form for permanent accreditation of a journalist from a foreign media outlet;
2) a document confirming the applicant’s authority, and in the case of a journalist from a foreign media outlet, a document confirming employment or other contractual relations with the foreign media outlet;
3) a completed accreditation form in accordance with Appendix 1 to these Rules;
4) a 3x4 cm photograph in electronic format;
5) a copy of a foreign passport (for a foreign citizen), a stateless person’s certificate (for a stateless person) or an identity document (for a citizen of the Republic of Kazakhstan);
6) a copy of the notification of the Ministry on the accreditation of a representative office of a foreign media outlet in the Republic of Kazakhstan;
7) materials (publications, articles) of a journalist of a foreign media outlet related to the Republic of Kazakhstan and published by a representative office of a foreign media outlet over the last 6 (six) months before the date of filing the application (for journalists of foreign media outlets who had permanent accreditation during this period).

For temporary accreditation of a journalist of a foreign media outlet, the applicant or journalist of a foreign media outlet shall submit to the Ministry in person or via the official e-mail address:
1) a signed petition in any form for temporary accreditation of a journalist of a foreign media outlet, indicating the period of accreditation, the purpose and date of the planned event on the territory of the Republic of Kazakhstan, which is submitted no later than 15 (fifteen) calendar days before the date of the specified event;
2) the documents specified in subparagraphs 2), 3), 4) and 5) of paragraph 16 of these Rules.
18. In the event of submission of an incomplete set of documents in accordance with the lists provided for in paragraphs 16 and 17 of these Rules, and/or documents with an expired period of validity, the Ministry shall return them without consideration within 3 (three) working days from the date of submission of the documents.
The return of documents shall not be the grounds for refusing to consider them upon re-application after the reasons for the return of the documents have been eliminated.
19. The Ministry, within 2 (two) months from the date of receipt of the documents for permanent accreditation specified in paragraph 16 of these Rules, shall review them and notify in writing the person who applied for accreditation:
1) on permanent accreditation with the issuance of an accreditation certificate for a journalist of a foreign media outlet (hereinafter referred to as an Accreditation certificate) in the form in accordance with Appendix 2 to these Rules;
2) on the refusal to grant permanent accreditation to a journalist of a foreign media outlet, with justification for the reasons for making such a decision.
20. The Ministry, within 15 (fifteen) calendar days from the date of receipt of the documents for temporary accreditation specified in paragraph 17 of these Rules, shall review them and notify in writing the person applying for accreditation:
1) on temporary accreditation with the issuance of an accreditation certificate for a journalist of a foreign media outlet in the form in accordance with Appendix 3 to these Rules;
2) on the refusal to grant temporary accreditation to a journalist of a foreign media outlet, with justification for the reasons for making such a decision.
21. The period for reviewing documents for permanent and temporary accreditation of journalists of foreign media shall be extended by a reasoned decision of the head of the Ministry or his deputy for a reasonable period, but no more than 2 (two) months, due to the need to establish factual circumstances that are significant for their proper consideration, of which the person applying for accreditation shall be notified within 3 (three) working days from the date of extension of the period.
22. The decision to refuse permanent or temporary accreditation to a journalist of a foreign media outlet shall be made in the following cases:
1) establishing the fact that the person applying for accreditation provided false information (documents) when applying for accreditation;
2) violation of the legislation of the Republic of Kazakhstan by a journalist of a foreign media outlet;
3) entry into force of a decision of a court of the Republic of Kazakhstan on the suspension or termination of the publication/broadcasting of a foreign media outlet, or the distribution of products of a foreign media outlet on the territory of the Republic of Kazakhstan;
4) lack of accreditation of a representative office of a foreign media outlet of which the journalist is an employee (for permanent accreditation).
23. In the event of loss of an accreditation certificate, the applicant or journalist of a foreign media outlet shall submit to the Ministry, in person or via the official e-mail address, a signed application in any form for its replacement.
The Ministry shall issue an accreditation certificate within 5 (five) working days from the date of acceptance of the application.
24. A journalist of a foreign media outlet shall, no later than 3 (three) working days from the date of change of the information specified in the accreditation form, inform the Ministry of the changes made.
Section 2. Procedure for suspension and revocation of accreditation of journalists of foreign media
25. The accreditation of a journalist of a foreign media outlet shall be suspended in the following cases:
1) the entry into force of a decision of a court of the Republic of Kazakhstan on the suspension of the publication/broadcasting of a foreign media outlet, or the distribution of the products of a foreign media outlet on the territory of the Republic of Kazakhstan for the period and under the conditions specified in such decision of the court of the Republic of Kazakhstan;
2) failure to provide information to the Ministry in accordance with paragraph 24 of these Rules;
3) violation of the legislation of the Republic of Kazakhstan by a journalist of a foreign media outlet;
4) a decision of the Ministry to suspend the accreditation of a representative office of a foreign media outlet that is the employer of a journalist of a foreign media outlet, for the period and under the conditions specified in such decision of the Ministry (for permanent accreditation).
26. The revocation of accreditation of a journalist of a foreign media outlet shall be carried out in the following cases:
1) entry into force of a decision of the court of the Republic of Kazakhstan on the termination of the publication of a foreign media outlet, or the distribution of products of a foreign media outlet on the territory of the Republic of Kazakhstan;
2) entry into force of decisions of the court of the Republic of Kazakhstan and (or) administrative acts of authorized bodies of the Republic of Kazakhstan for violation of the legislation of the Republic of Kazakhstan;
3) a decision of the Ministry to revoke the accreditation of a representative office of a foreign media outlet that is the employer of the journalist;
4) termination of employment or other contractual relations between a foreign media outlet and its journalist;
5) violation by a journalist of a foreign media outlet of the legislation of the Republic of Kazakhstan within 1 (one) year after suspension of accreditation;
6) the submission by the applicant or a journalist of a foreign media outlet of an application for early termination of the accreditation of a journalist of a foreign media outlet;
7) absence, for a period of 6 (six) months, of publication of materials confirming the implementation of journalistic activities by a foreign media journalist on the territory of the Republic of Kazakhstan (for permanent accreditation);
8) entry into force of a judgment of the court of the Republic of Kazakhstan on bringing a journalist of a foreign media outlet to criminal liability;
9) failure to comply with Articles 19 and 20 of the International Covenant on Civil and Political Rights, ratified by the Law of the Republic of Kazakhstan “On Ratification of the International Covenant on Civil and Political Rights”;
10) termination of the activities of a foreign media outlet whose representative office is accredited in the Republic of Kazakhstan, upon receipt of this information by the Ministry;
11) receipt of information from state bodies of the Republic of Kazakhstan on the inconsistency of the activities of a foreign media journalist with the officially declared purpose.
27. In the event of suspension or revocation of the accreditation of a journalist of a foreign media outlet, the Ministry shall notify the foreign media outlet and the journalist of the foreign media outlet in writing of the suspension or revocation of his accreditation no later than 3 (three) working days from the date of the decision.
The accreditation certificate shall be submitted to the Ministry within 3 (three) working days from the date of receipt of the notification.
28. After the circumstances that served as the grounds for suspending the accreditation of a journalist of a foreign media outlet have been eliminated, the Ministry shall, within 3 (three) working days, renew the accreditation and notify him and the foreign media outlet in writing of this decision.
Section 3. Procedure for accreditation of journalists of foreign media included in foreign delegations
29. The procedure for accreditation of journalists of foreign media outlets included in foreign delegations to cover international events of the Republic of Kazakhstan at the highest and high levels shall be carried out by the Ministry based on an application (verbal note or letter) from a foreign state (international organization) received in person or through an official e-mail address.
The following documents shall be attached to the application:
1) a completed form for media accreditation in accordance with Appendix 4 to these Rules;
2) a 3x4 cm photograph in electronic format;
3) a copy of a foreign passport (for a foreign citizen), a stateless person’s certificate (for a stateless person) or an identity document (for a citizen of the Republic of Kazakhstan).

The Ministry, no later than 3 (three) working days from the date of receipt of the documents specified in paragraph 29 of these Rules, shall review them and notify the foreign state (international organization) in writing:
1) on accreditation of a journalist of a foreign media outlet;
2) on refusal to accredit a journalist of a foreign media outlet.
31. The decision to refuse accreditation to a journalist of a foreign media outlet shall be made in the following cases:
1) establishing the fact that false information (documents) was/were provided when applying for accreditation;
2) violation of the legislation of the Republic of Kazakhstan by a journalist of a foreign media outlet.
