1) state registration of this Order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this Order in the Ministry of Justice of the Republic of Kazakhstan, referral for official publication in periodicals and the information and legal system "Adilet";
3) posting this Order on the official Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan.
4. Supervision over the implementation of this Order shall be assigned to the First Deputy Minister of Foreign Affairs of the Republic of Kazakhstan, R.S. Zhoshybaev.
5. This Order shall come into effect upon expiration of ten calendar days after the date of its first official publication.

Chapter 1. Registration

1. Registration with the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter referred to as the Ministry) of children who are citizens of the Republic of Kazakhstan and who have been placed for adoption by foreign nationals (hereinafter referred to as children) shall be carried out by the Ministry before the children leave the territory of the Republic of Kazakhstan.

To register children, adoptive parents or their authorized representatives (hereinafter referred to as the Applicant) shall submit the following documents to the Ministry:
1) an application for registration of children, in the form according to Appendix 1 to these Rules, in two copies;
2) a personal registration card for children, completed in accordance with the form in Appendix 2 to these Rules, in two copies;
3) the original passport of a citizen of the Republic of Kazakhstan (hereinafter referred to as the Passport) issued to a child – a citizen of the Republic of Kazakhstan, placed for adoption by foreign nationals (hereinafter referred to as the Child);
4) a decision on the processing of documents for the child’s departure from the Republic of Kazakhstan for permanent residence, issued by the internal affairs bodies of the Republic of Kazakhstan (for verification);
5) documents certifying the identity of the adoptive parents (for identification and verification);
6) two color photographs of the child, measuring 3.5 x 4.5 centimeters;
7) child’s birth certificate (for verification);
8) a court decision on satisfying the application of foreign citizens for adoption, certified by the court (for verification).
The list of the main requirements for the provision of the public service “Registration of children who are citizens of the Republic of Kazakhstan, placed for adoption by foreign nationals” (hereinafter referred to as the Public service), including the characteristics of the process, form, content and result of provision, as well as other information taking into account the specifics of the provision of the public service, is provided in Appendix 2-1 to these Rules.
Registration of children shall be carried out within five working days from the date of submission of the documents specified in paragraph 2 of these Rules.

In the event of incomplete data being provided when filling out and/or submitting an incomplete package of documents specified in paragraph 2 of these Rules, or documents with an expired validity period, the acceptance of documents for registration of children will not be carried out, and the applicant will be given a receipt of refusal to accept documents.
After the deficiencies have been corrected, the documents shall be re-submitted on a general basis.

If the applicant provides the full package of documents specified in paragraph 2 of these Rules, an employee of the responsible structural unit of the Ministry will accept and register the application. The documents specified in subparagraphs 3), 4), 5), 7), and 8) of paragraph 2 of these Rules shall be copied in two copies to form the file.
The documents specified in subparagraphs 4), 5), 7), 8) of paragraph 2 of these Rules shall be returned to the applicant.
Confirmation of acceptance of a paper application shall be a mark on its copy indicating registration in the Ministry's office, indicating the date of its receipt, the last name, first name and patronymic (if any) of the person receiving it, and the time of receipt of the package of documents.
An employee of the responsible structural unit of the Ministry, within five working days from the date of submission of documents, checks the received documents for compliance with the requirements of these Rules and registers children.
After registration, the document specified in subparagraph 3) of paragraph 2 of these Rules shall be returned to the applicant.
If grounds for refusal to provide a public service are identified, the service provider shall inform the service recipient within two calendar days of the preliminary decision to refuse to provide the public service, as well as the time, date, place, and method of conducting a hearing to provide the service recipient with the opportunity to express their position on the preliminary decision.
Notice of the hearing shall be sent no less than three business days before the end of the public service provision period. The hearing will take place no later than two business days from the date of notification.
Based on the results of the hearing, the service provider registers children who are citizens of the Republic of Kazakhstan and who have been placed for adoption by foreign nationals, or refuses to provide the public service.

Paragraph 4 - as amended by the Order of the Acting Minister of Foreign Affairs of the Republic of Kazakhstan dated September 27, 2022 No. 11-1-4/497 (shall come into effect ten calendar days after the date of its first official publication); as amended by the Order of the Minister of Foreign Affairs of the Republic of Kazakhstan dated June 16, 2026 No. 11-1-4/328 (shall come into effect on July 1, 2026).4-1. Refusal to provide a public service shall be carried out on the grounds specified in paragraph 9 of the List of Basic Requirements for the Provision of a Public Service.

When registering, an insert in the form in Appendix 3 to these Rules shall be attached to the child’s passport.
A stamp in the form according to Appendix 4 of these Rules, indicating the sequence number, date, as well as the place of the seal and the signature of the consular official, shall be affixed to the passport insert.
If the child’s passport does not contain an insert and a registration stamp, the child shall not be allowed to leave the territory of the Republic of Kazakhstan.
6. Information about registered children shall be entered into the children’s registration journal in the form according to Appendix 5 to these Rules with subsequent mandatory entry into the Unified Information System “Berkut” (hereinafter referred to as the UIS “Berkut”).
The Ministry shall provide the authorized body for the protection of children's rights of the Republic of Kazakhstan (hereinafter referred to as the Authorized body) with lists of children registered every month.
6-1. In accordance with subparagraph 11) of paragraph 2 of Article 5 of the Law on Public Services, the Ministry shall ensure the entry of data into the information system for monitoring the provision of public services at the stage of provision of the public service.

The consideration of a complaint regarding the provision of public services shall be carried out by a higher administrative body, an official, or an authorized body for the assessment and control of the quality of provision of public services (hereinafter referred to as the Body considering the complaint).
The complaint shall be submitted to the service provider and/or the official whose decision, action (inaction) is being appealed.
The service provider or official whose decision, action (inaction) is being appealed shall, no later than three working days from the date of receipt of the complaint, send it and the administrative case to the body considering the complaint.
In this case, the service provider, the official whose decision, action (inaction) is being appealed, has the right not to send the complaint to the body considering the complaint if it makes a decision or other administrative action within three working days that fully satisfies the requirements specified in the complaint.
A complaint from a service recipient received by a service provider, in accordance with paragraph 2 of Article 25 of the Law on Public Services, is subject to review within five working days from the date of its registration.
A service recipient's complaint received by the body considering the complaint is subject to review within fifteen working days from the date of its registration.
Unless otherwise provided by the laws of the Republic of Kazakhstan, an appeal to the court shall be permitted after an appeal in a pre-trial procedure in accordance with paragraph 5 of Article 91 of the Administrative Procedure Code of the Republic of Kazakhstan.

In the event of amendments and/or additions to this Order, the Ministry shall send information on the procedure for providing the public service to the Unified Contact Center within ten calendar days of registration in the Register of State Registration of Regulatory Legal Acts.

Implementation of control over children by foreign institutions of the Republic of Kazakhstan

7. The Ministry shall, within ten working days, inform the foreign mission of the Republic of Kazakhstan (hereinafter referred to as the Foreign mission), in the consular district where the child resides, of the registration completed and shall send a second copy of the documents specified in subparagraphs 1), 2) and copies of the documents specified in subparagraphs 3), 4), 5), 7), 8) of paragraph 2 of these Rules.

Paragraph 7 - as amended by Order No. 11-1-4/237 of the Minister of Foreign Affairs of the Republic of Kazakhstan dated June 15, 2021 (shall come into effect ten calendar days after its first official publication).8. After receiving information from the Ministry, the consular officer of the foreign institution shall immediately make an entry in the children’s registration log, using the form in Appendix 6 to these Rules.
9. A consular officer, within his/her consular district, shall exercise control over children until they reach the age of majority and shall visit adoptive parents to check the living conditions, upbringing and health of the children.
Monitoring shall be carried out to ensure compliance with the rights of children established by the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family", the Law of the Republic of Kazakhstan "On the Rights of the Child in the Republic of Kazakhstan" and international treaties of the Republic of Kazakhstan.
Control shall be carried out taking into account compliance with the legislation of the host state.

Paragraph 9 as amended by Order No. 11-1-4/497 of the Acting Minister of Foreign Affairs of the Republic of Kazakhstan dated September 27, 2022 (shall come into effect ten calendar days after the date of its first official publication).10. During the first three years after the entry into force of the court decision on adoption, adoptive parents shall submit to the authorized body every six months, and in subsequent years – at least once a year until the child reaches the age of eighteen reports on the living conditions, education, upbringing and health status of the adopted child with attached photographs (hereinafter referred to as the Report).
When the report is submitted by the adoptive parents through a foreign institution, the consular officer of the foreign institution shall send it to the Ministry for subsequent forwarding to the authorized body.
In the event of receipt of information about failure to submit a report to the authorized body, the consular officer shall request a report from the adoptive parents and/or adoption agencies (hereinafter referred to as the Agency) and shall send it to the Ministry.
11. In cases where it is established that adoptive parents are evading the performance of their parental responsibilities, abusing their parental rights, cruelly treating the adopted child, including committing physical or mental violence against him/her, or encroaching on his/her sexual integrity, the consular officer shall immediately:
inform the authorized body and the Ministry;
take measures to protect the rights and interests of the adopted child within the limits permitted by the legislation of the Republic of Kazakhstan, the host country and international treaties of the Republic of Kazakhstan.
Chapter 3. Change of children's place of residence

12. When changing the child’s place of residence, the adoptive parents, within five working days, send to the agency and the foreign institution where the said child is registered a notification of the change of place of residence of the adopted child, in the form according to Appendix 7 to these Rules.
13. Upon receipt of notification of a change in the child’s place of residence within one consular district, the consular officer of the foreign mission shall make a record of the change in the place of residence in the register of children with subsequent mandatory entry into the Berkut Unified Information System.
14. If a child changes his/her place of residence outside the consular district of a foreign mission, the consular officer shall:
make an entry in the register of children regarding deregistration with subsequent mandatory entry into the Berkut Unified Information System and inform the Ministry about this;
send the documents specified in subparagraphs 1), 2) and copies of the documents specified in subparagraphs 3), 4), 5), 7), 8) of paragraph 2 of these Rules to the foreign institution in whose consular district the child’s new place of residence falls.

Explanation on filling out the form "Register of Children"
(Index: 1- УД, frequency: monthly)
1. Column 1 shall indicate the consular registration number of a child who is a citizen of the Republic of Kazakhstan and who has been placed for adoption by foreign nationals.
2. Column 2 shall indicate the last name, first name, patronymic (if any) of the child before adoption, who is a citizen of the Republic of Kazakhstan, placed for adoption by foreign nationals.
3. Column 3 shall indicate the date and place of birth of a child who is a citizen of the Republic of Kazakhstan and who was placed for adoption to foreign citizens.
4. Column 4 shall indicate the last name, first name, patronymic (if any), and citizenship of the parents of a child who is a citizen of the Republic of Kazakhstan, before adoption by foreign citizens.
5. Column 5 shall indicate the name and address of the institution from which the adoption of a child who is a citizen of the Republic of Kazakhstan was carried out by foreign citizens.
6. Column 6 shall indicate the last name, first name, patronymic (if any) of a child who is a citizen of the Republic of Kazakhstan, after adoption by foreign citizens.
7. Column 7 shall indicate the last name, first name, patronymic (if any), and citizenship of the foreign adoptive parents of a child who is a citizen of the Republic of Kazakhstan.
8. Column 8 shall indicate the place of residence of foreign adoptive parents of a child who is a citizen of the Republic of Kazakhstan.
9. Column 9 shall indicate the name of the court that decided on the adoption of a child who is a citizen of the Republic of Kazakhstan by foreign citizens.
10. Column 10 shall indicate the name of the internal affairs agency of the Republic of Kazakhstan that issued the passport of the adopted child who is a citizen of the Republic of Kazakhstan, foreign citizens, the number and date of issue of the passport.
