To declare as invalid the order of the Acting Minister of Foreign Affairs of the Republic of Kazakhstan dated December 9, 2016 № 11-1-2/585 "On approval of the Rules for the acceptance from persons permanently residing outside the Republic of Kazakhstan of applications on issues of citizenship of the Republic of Kazakhstan and submission thereof together with the necessary documents for consideration by the President of the Republic of Kazakhstan" (registered in the Register of State Registration of Regulatory Legal Acts under № 14797, published in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan on March 9, 2017).
4. Control over execution of this order shall be assigned to the First Deputy Minister of Foreign Affairs of the Republic of Kazakhstan Tleuberdi M.B.
5. This order shall be enforced upon expiry of ten calendar days after the day of its first official publication.

Rules for the acceptance and consideration by foreign missions of the Republic of Kazakhstan of applications on issues of citizenship of the Republic of Kazakhstan, registration of loss of citizenship of the Republic of Kazakhstan and determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan

Chapter 1. General provisions
1. These Rules for the acceptance and consideration by foreign missions of the Republic of Kazakhstan (hereinafter - foreign missions) of applications on issues of citizenship of the Republic of Kazakhstan (hereinafter - applications on citizenship issues), registration of loss of citizenship of the Republic of Kazakhstan and determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan (hereinafter - the Rules) have been developed in accordance with Article 31 of the Law of the Republic of Kazakhstan "On citizenship of the Republic of Kazakhstan" (hereinafter - the Law), subparagraph 153) of paragraph 15 of the Regulation on the Ministry of Foreign Affairs of the Republic of Kazakhstan, approved by Resolution of the Government of the Republic of Kazakhstan dated October 28, 2004 № 1118, and determine the procedure for the acceptance and consideration by foreign missions of applications on citizenship issues from persons permanently residing outside the Republic of Kazakhstan, registration of loss of citizenship of the Republic of Kazakhstan and determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan of persons residing outside the Republic of Kazakhstan.
2. The following concepts shall be used in these Rules:
1) applicant - a person who has submitted to a foreign mission applications on citizenship issues, registration of loss of citizenship of the Republic of Kazakhstan and determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan;
2) foreign missions - diplomatic and equivalent representations located abroad, as well as consular institutions of the Republic of Kazakhstan.
3. For processing documents on citizenship issues and issuance of certificates on registration of loss of citizenship of the Republic of Kazakhstan or on determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan, a consular fee shall be charged in the amounts provided for by the order of the Minister of Foreign Affairs of the Republic of Kazakhstan dated May 20, 2019 № 11-1-4/227 (registered in the Register of State Registration of Regulatory Legal Acts under № 18702) "On approval of the rates of consular fees for the performance of consular actions on the territory of a foreign state".
4. Documents issued, drawn up or certified in the established form by competent authorities of foreign states shall be accepted subject to legalization, unless otherwise provided for by the legislation of the Republic of Kazakhstan or an international treaty ratified by the Republic of Kazakhstan.
Documents drawn up in a foreign language shall be accompanied by their duly certified translation into the state and (or) Russian languages.
Chapter 2. Procedure for the acceptance and consideration of applications on citizenship issues
5. Applications on citizenship issues shall include:
1) an application for admission to citizenship of the Republic of Kazakhstan;
2) an application for restoration of citizenship of the Republic of Kazakhstan;
3) an application for renunciation of citizenship of the Republic of Kazakhstan.
6. Applications on citizenship issues shall be subject to registration and consideration by foreign missions, the National Security Committee of the Republic of Kazakhstan (hereinafter - the National Security Committee) and the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter - the Ministry) within a period of no later than 1 (one) month from the day of their receipt by each of these state bodies.
In accordance with Article 32 of the Law, the total period for consideration of applications on citizenship issues shall not exceed 6 (six) months from the day of submission of the complete package of documents to the foreign mission.
7. An application for admission to citizenship of the Republic of Kazakhstan shall be drawn up in free form and submitted in the name of the President of the Republic of Kazakhstan through foreign missions by minors, legally incapable persons at the request of their legal representatives, certified by the foreign mission, and by persons who have special merits before the Republic of Kazakhstan or who correspond to the list of professions and requirements for persons in respect of whom a simplified procedure for admission to citizenship of the Republic of Kazakhstan is established, approved by Decree of the President of the Republic of Kazakhstan dated June 6, 2005№ 1587 "On approval of the list of professions and requirements for persons in respect of whom a simplified procedure for admission to citizenship of the Republic of Kazakhstan is established" (hereinafter - the List), and members of their families, permanently residing outside the Republic of Kazakhstan, with the attachment of the following documents:
1) an application form in accordance with Annex 1 to these Rules;
2) an autobiography (written personally);
3) a photograph measuring 3.5 x 4.5 centimeters;
4) a document confirming permanent residence outside the Republic of Kazakhstan;
5) a certificate of the presence or absence of a criminal record, issued by a competent authority of a foreign state;
6) a certificate of the absence or termination of citizenship of another state, issued by a competent authority of a foreign state;
7) copies of birth certificates of children and marriage certificates (if available);
8) a statement of consent to comply with the conditions provided for by Article 1 of the Law in the form according to Annex 2 to these Rules;
9) a document confirming payment of the consular fee;
10) a copy of an identity document;
11) consent to admission to citizenship of the Republic of Kazakhstan, expressed in written form and certified by the foreign mission (upon admission to citizenship of the Republic of Kazakhstan of persons aged 14 to 18 years);
12) a petition from a relevant state body of the Republic of Kazakhstan (upon admission to citizenship of the Republic of Kazakhstan of persons who have special merits before the Republic of Kazakhstan or who correspond to the List, and members of their families).
8. An application for restoration of citizenship of the Republic of Kazakhstan shall be drawn up in free form and submitted in the name of the President of the Republic of Kazakhstan through foreign missions by persons permanently residing outside the Republic of Kazakhstan, with the attachment of:
1) the documents specified in subparagraphs 1), 2), 3), 4), 5), 6), 7), 8), 9), 10) and 11) of paragraph 7 of these Rules;
2) documents confirming former belonging to citizenship of the Republic of Kazakhstan;
3) documents confirming knowledge of the state language at an elementary level, the fundamentals of the Constitution of the Republic of Kazakhstan, as well as the history of Kazakhstan in the scope according to the order of the Minister of Science and Higher Education of the Republic of Kazakhstan dated October 8, 2024 № 479 (registered in the Register of State Registration of Regulatory Legal Acts under № 35233) "On approval of the scope of knowledge of the state language at an elementary level, the fundamentals of the Constitution of the Republic of Kazakhstan, as well as the history of Kazakhstan upon admission to citizenship or restoration of citizenship of the Republic of Kazakhstan" (shall not apply to minors, legally incapable persons, persons who have special merits before the Republic of Kazakhstan or have professions and meet the requirements under the List, and ethnic Kazakhs).
9. An application for renunciation of citizenship of the Republic of Kazakhstan shall be drawn up in free form and submitted in the name of the President of the Republic of Kazakhstan through foreign missions by citizens of the Republic of Kazakhstan permanently residing outside the Republic of Kazakhstan, with the attachment of the following documents:
1) an application form in accordance with Annex 3 to these Rules;
2) an autobiography (written personally);
3) a photograph measuring 3.5 x 4.5 centimeters;
4) a decision on processing documents for departure from the Republic of Kazakhstan for permanent residence, processed by the internal affairs bodies of the Republic of Kazakhstan in accordance with the order of the Minister of Internal Affairs of the Republic of Kazakhstan dated March 27, 2020 № 259 "On approval of the Rules for the provision of the state service "Processing of documents for departure from the Republic of Kazakhstan for permanent residence" (registered in the Register of State Registration of Regulatory Legal Acts under № 20207), or a notification on processing of permission for departure from the Republic of Kazakhstan for permanent residence, processed by a foreign mission in accordance with the order of the Minister of Foreign Affairs of the Republic of Kazakhstan dated January 4, 2018 № 11-1-4/1 "On approval of the Rules for the acceptance and submission of documents of citizens of the Republic of Kazakhstan who have left the Republic of Kazakhstan on temporary business and have expressed a desire to remain there for permanent residence" (registered in the Register of State Registration of Regulatory Legal Acts under № 16354);
5) a certificate of the presence or absence of a criminal record, processed in accordance with the Rules for the provision of the state service "Issuance of a certificate of the presence or absence of a criminal record", approved by the order of the Prosecutor General of the Republic of Kazakhstan dated May 18, 2020 № 64 "On approval of the Rules for the provision of state services by the Committee on Legal Statistics and Special Accounts of the General Prosecutor's Office of the Republic of Kazakhstan and its territorial bodies" (registered in the Register of State Registration of Regulatory Legal Acts under № 20674);
6) copies of birth certificates of children and marriage certificates (if available);
7) a document confirming the possibility of obtaining foreign citizenship;
8) a document confirming payment of the consular fee;
9) a notarized statement of consent to renunciation of citizenship of the Republic of Kazakhstan and on the absence of material and other claims from the spouse, parents of the applicant or persons dependent on him/her residing in the Republic of Kazakhstan, or copies of their death certificates, a court decision on declaring a citizen deceased or missing (if available);
10) a copy of an identity document.
10. In the event of submission of an incomplete package of documents in accordance with paragraphs 7, 8 and 9 of these Rules and (or) documents with an expired validity period, the foreign mission shall, within 2 (two) working days from the day of receipt of the application on citizenship issues, notify the applicant thereof.
The period for bringing documents into compliance shall be 2 (two) working days from the day of notification of the applicant by the foreign mission.
The foreign mission shall return the documents if the applicant has not brought them into compliance with the requirements of these Rules within the period established by part two of this paragraph.
The return of documents shall not preclude a repeated application.
11. In the event of submission of a complete package of documents in accordance with paragraphs 7, 8 and 9 of these Rules, the foreign mission shall carry out the following actions:
1) explain to the applicant the legal consequences of acquisition or termination of citizenship of the Republic of Kazakhstan by him/her, as well as the provisions of Article 3 of the Law, in accordance with which citizenship of a foreign state shall not be recognized for a citizen of the Republic of Kazakhstan, about which a note shall be made in the application form;
2) consider the accepted documents and draw up a conclusion for each family member of the applicant in the form according to Annex 4 to these Rules;
3) enter information about the applicant and each member of his/her family into the unified information system "Berkut" (hereinafter - UIS "Berkut") ensuring the completeness of the entered information.
12. The National Security Committee shall carry out consideration and approval of the information about the applicant and members of his/her family entered by the foreign mission into UIS "Berkut".
13. After approval by the National Security Committee, the foreign mission shall submit the conclusions and processed documents on citizenship issues (hereinafter - materials on citizenship issues) to the Ministry.
14. The Ministry shall consider materials on citizenship issues and, in the event of their compliance with the Law and (or) these Rules, shall draw up a reasoned conclusion on the advisability of admission to citizenship of the Republic of Kazakhstan or restoration thereof for each applicant permanently residing outside the territory of the Republic of Kazakhstan, including the possibility of his/her employment, housing and other settlement in the Republic of Kazakhstan, as well as conclusions on renunciation of citizenship of the Republic of Kazakhstan, and shall submit them to the Administration of the President of the Republic of Kazakhstan.
15. In the event of identification of non-compliance of materials on citizenship issues with the Law and (or) these Rules, the Ministry shall notify the foreign mission of the need to bring them into compliance with the Law and (or) these Rules.
The period for eliminating deficiencies shall be 10 (ten) working days from the day of receipt of the Ministry's notification.
If it is impossible to eliminate deficiencies within the period specified in part two of this paragraph, consideration of materials on citizenship issues shall be suspended by the foreign mission until the deficiencies are eliminated by the applicant, about which the applicant and the Ministry shall be notified in writing within 3 (three) working days.
16. The Ministry, upon receipt of a notification from the foreign mission on suspension of consideration of materials on citizenship issues, shall return them to the foreign mission.
17. After the applicant eliminates the deficiencies specified in the notification in accordance with paragraph 15 of these Rules, the foreign mission shall submit materials on citizenship issues to the Ministry, which shall carry out the action in accordance with paragraph 14 of these Rules.
In the event of failure to eliminate deficiencies within 1 (one) month from the day of suspension of consideration of materials on citizenship issues, the foreign mission shall return to the applicant the documents submitted by him/her on the citizenship issue.
The return of documents shall not preclude a repeated application.
18. Materials on citizenship issues together with the conclusions of the Ministry shall be considered in the Administration of the President of the Republic of Kazakhstan in accordance with the Law and the Decree of the President of the Republic of Kazakhstan dated October 10, 2006 № 198 "On the Commission on Citizenship Issues under the President of the Republic of Kazakhstan".
19. On issues of admission, restoration and renunciation of citizenship of the Republic of Kazakhstan and upon rejection of an application on citizenship issues, a Decree of the President of the Republic of Kazakhstan shall be issued.
A repeated application on a citizenship issue shall be considered after expiry of 1 (one) year after the previous decision on this issue.
In the event of the emergence of circumstances material to the case that were not and could not have been known to the applicant, a repeated application shall be accepted by the foreign mission without regard to the requirements of the period specified in part two of this paragraph.
20. The Ministry shall, within 3 (three) working days from the day of receipt of the Decree of the President of the Republic of Kazakhstan on citizenship issues, submit it to the foreign mission.
The foreign mission shall, within 3 (three) working days from the day of receipt of the Decree of the President of the Republic of Kazakhstan on citizenship issues, notify the applicant of the decision adopted by the President of the Republic of Kazakhstan on the citizenship issue.
21. Refusal of admission, restoration and renunciation of citizenship of the Republic of Kazakhstan shall be carried out on the grounds provided for by Articles 17 and 20 of the Law.
22. In the event of rejection of an application on citizenship issues, the foreign mission shall, no less than 3 (three) working days prior to the adoption of the administrative act, notify the applicant of the preliminary decision on refusal of admission, restoration, renunciation of citizenship of the Republic of Kazakhstan, as well as the time, date and place, and the manner of conducting the hearing to provide the applicant with the opportunity to express his/her position on the preliminary decision.
The applicant shall provide or state objections to the preliminary decision no later than 2 (two) working days from the day of receipt of the preliminary decision.
Based on the results of the hearing, the foreign mission shall adopt a decision on further consideration of the application on citizenship issues in accordance with these Rules or shall refuse admission, restoration and renunciation of citizenship of the Republic of Kazakhstan.
Chapter 3. Procedure for registration of loss of citizenship of the Republic of Kazakhstan by a person residing outside the Republic of Kazakhstan
23. Registration of loss of citizenship of the Republic of Kazakhstan in respect of a person residing outside the Republic of Kazakhstan shall be carried out by the foreign mission upon receipt of:
1) his/her application for registration of loss of citizenship of the Republic of Kazakhstan, drawn up in free form, in the presence of one of the documents confirming the grounds provided for by part one of Article 21 of the Law.
The originals of the passport and identity card (if available) of a citizen of the Republic of Kazakhstan shall be attached to the application.
In the event of absence or loss of the passport and (or) identity card of a citizen of the Republic of Kazakhstan, a written explanation of the applicant and documents confirming this fact (if available) shall be provided;
2) an official notification of state bodies of the Republic of Kazakhstan or competent authorities of a foreign state on the existence of the grounds provided for by Article 21 of the Law.
24. In the event of submission of an incomplete package of documents in accordance with subparagraph 1) of paragraph 23 of these Rules, the foreign mission shall, within 2 (two) working days from the day of receipt of the application for registration of loss of citizenship of the Republic of Kazakhstan, notify the applicant thereof.
The period for bringing documents into compliance shall be 2 (two) working days from the day of notification of the applicant by the foreign mission.
The foreign mission shall return the documents if the applicant has not brought them into compliance with the requirements of these Rules within the period established by part two of this paragraph.
The return of documents shall not preclude a repeated application.
25. The foreign mission shall, within 10 (ten) working days from the day of receipt of the documents specified in paragraph 23 of these Rules, draw up a conclusion on registration of loss of citizenship of the Republic of Kazakhstan by a person residing outside the Republic of Kazakhstan in the form according to Annex 5 to these Rules, enter the relevant information into UIS "Berkut" and notify the applicant of the loss of citizenship of the Republic of Kazakhstan.
Upon receipt of an application for issuance of a certificate of loss of citizenship of the Republic of Kazakhstan, the foreign mission shall, within 5 (five) working days, issue to the applicant a corresponding certificate drawn up in free form.
26. In the event of doubts as to the authenticity of the submitted documents and information, the foreign mission shall verify their authenticity by sending inquiries to state bodies of the Republic of Kazakhstan and (or) competent authorities of a foreign state.
The period specified in part one of paragraph 25 of these Rules shall be extended by a reasoned decision of the head of the foreign mission or a person performing his/her duties for a reasonable period, but not more than up to 2 (two) months, due to the need to establish factual circumstances material to their proper consideration, about which the applicant shall be notified within 3 (three) working days from the day of extension of the period.
27. Calculation of the date of loss of citizenship of the Republic of Kazakhstan shall be carried out in accordance with the legislation of the Republic of Kazakhstan.
28. The foreign mission shall, within 5 (five) working days from the day of registration of loss of citizenship of the Republic of Kazakhstan, inform the Republican State Enterprise "Information and Production Center" of the Ministry of Internal Affairs of the Republic of Kazakhstan (hereinafter - RSE "IPC") of the registration of loss of citizenship for entering information into the information database of the documented population of the Republic of Kazakhstan.
29. Withdrawn passports and identity cards of a citizen of the Republic of Kazakhstan shall be stored in the safe of the consular archive and shall be submitted by the foreign mission to RSE "IPC" within 1 (one) month from the day of registration of loss of citizenship of the Republic of Kazakhstan.
Chapter 4. Procedure for determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan of a person residing outside the Republic of Kazakhstan
30. A person residing outside the Republic of Kazakhstan shall, for determination of belonging (non-belonging) to citizenship of the Republic of Kazakhstan, submit the following documents to the foreign mission (hereinafter - materials on determination of citizenship):
1) an application form in accordance with Annex 6 to these Rules;
2) a photograph measuring 3.5 x 4.5 centimeters;
3) a document on the absence of citizenship of a foreign state, processed in accordance with the legislation of the foreign state;
4) other documents relevant to the case (if available): birth certificate, documents confirming employment, military service record, certificate of secondary or incomplete secondary education, diploma, archival certificate - an extract from the household register, statements of no less than three witnesses confirming the fact of residence of the applicant in the Republic of Kazakhstan.
31. In the event of submission of an incomplete package of documents in accordance with paragraph 30 of these Rules and (or) documents with an expired validity period, the foreign mission shall, within 2 (two) working days from the day of receipt of materials on determination of citizenship, notify the applicant thereof.
The period for bringing documents into compliance shall be 10 (ten) working days from the day of notification of the applicant by the foreign mission.
The foreign mission shall return the documents if the applicant has not brought them into compliance with the requirements of these Rules within the period established by part two of this paragraph.
The return of documents shall not preclude a repeated application.
32. In the event of submission of a complete package of documents in accordance with paragraph 30 of these Rules, the foreign mission shall determine the belonging (non-belonging) of the applicant to citizenship of the Republic of Kazakhstan through UIS "Berkut" by entering the identifying data specified in the application form.
33. In the event of absence of information about the applicant in UIS "Berkut", the foreign mission shall, to obtain information about the applicant, submit an inquiry to the internal affairs bodies of the Republic of Kazakhstan with the attachment of copies of materials on determination of citizenship.
34. The internal affairs bodies of the Republic of Kazakhstan shall, within 5 (five) working days from the day of receipt of the inquiry, consider it and submit information about the applicant to the foreign mission.
35. The foreign mission shall, within 5 (five) working days from the day of receipt from the internal affairs bodies of the Republic of Kazakhstan of information about the applicant, determine his/her belonging (non-belonging) to citizenship of the Republic of Kazakhstan and inform him/her in written form.
36. Upon receipt of an application for issuance of a certificate confirming belonging (non-belonging) to citizenship of the Republic of Kazakhstan, the foreign mission shall issue a corresponding certificate drawn up in free form.
Chapter 5. Procedure for appealing decisions, actions (omissions) of foreign missions and (or) their officials
37. A complaint shall be submitted to the foreign mission, the official whose decision, action (omission) is being appealed.
The foreign mission, the official whose decision, action (omission) is being appealed shall, no later than 3 (three) working days from the day of receipt of the complaint, submit it and the administrative case to the Ministry.
At the same time, the foreign mission, the official whose administrative act, administrative action (omission) is being appealed shall have the right not to submit the complaint to the Ministry if it/he/she, within 3 (three) working days, adopts a favorable administrative act, performs an administrative action that fully satisfies the requirements specified in the complaint.
A complaint received by the Ministry shall be subject to consideration within 20 (twenty) working days from the day of its registration.
38. Unless otherwise provided for by the laws of the Republic of Kazakhstan, recourse to court shall be allowed after appeal in a pre-trial procedure in accordance with Paragraph 5 of Article 91 of the Administrative Procedural Code of the Republic of Kazakhstan.
